Know the truth about your case...

Before  trial

Mock Trial    *  Focus Groups *  Shadow Juries

The start of every case presents questions of enormous consequence. The investment required to pursue a civil matter significantly drains resources of both the client and counsel. The Mediation Institute uses jury research and  trial strategy techniques to help law firms and businesses  develop the most effective approach for witness preparation, jury selection and trial presentation. Our goal is to make your case more persuasive, which is why we bring you the necessary expertise to help you prepare and present your most strategic approach to the case.

The Mediation Institute offers an affordable means of assessing potential jury reactions to pending litigation using, Mock Trials, Shadow (Mirror) Juries, Focus Groups and Post Trial Examinations litigation issues will be exposed and evaluated to uncover the most likely outcome in the actual trial. This small investment in preparing for your case can  give your firm an immense advantage.

"Many of the most difficult decisions in litigation are difficult because trial juries are so unpredictable. The Mediation Institute’s Mock Trial Team removes much of the mystery, allowing your trial team to make more informed decisions about settlement and trial."

The strategies to pursue in deposition and discovery may seem logical to lawyers, but how will they be perceived by the jurors? Decisions in criminal cases regarding plea bargains similarly ignore the most important questions to be faced in any trial: What is the probable verdict? How will a jury react to the charges? What will they award? How can we improve the response to our case?

·   It tells you where you need to do more work and what you need to emphasize at trial, while warning you of where you are likely to be hurt should the case advance to a jury trial.

·    It evaluates your trial teams delivery of your case, and how your team members, and witnesses relate to the jury.

·    It helps alert you to the kind of jurors most likely to be a problem in the deliberation room.

·      It gives your trial team a straight forward evaluation of how the liability facts will stack up against the personal appeal of the case in a jury room.

We prefer to conduct our evaluations within the local county that the actual jury pool may be selected. All subjects are recruited through a process that involves public advertisement and random selection. Respondents are matched to general population characteristics of age, race and gender. Each participant in turn executes binding agreements on confidentiality and liability.

We combine the sciences of human nature with communication strategies, increasing the likelihood of a favorable verdict. Our firm reduces the uncertainty of trial through research and application in all phases of trial preparation. The objective is to identify and apply information on the characteristics, attitudes, and beliefs of potential jurors in order to predict  outcomes. Data collection and interpretation are focused on development of responsive themes and tactical lines around which the legal arguments of the case can best be communicated in simple terms  to the jury.
